Arbitration clauses in consumer contracts

The Supreme Court reviewed the whether arbitration clauses qualify as unfair in consumer contracts. The Court concluded that in accorance with Directive 93/13/EEC, such clauses are unfair. The result of the Supreme Court's position is that all arbitration clauses in consumer contracts, which are concluded by way of general terms are voidable.
